Resumo: O trabalho evidencia o racismo que baliza as práticas do sistema punitivo, expondo que o indivíduo negro está mais vulnerável à incidência da máquina penal, na medida em que os mecanismos de rotulação e estigmatização trabalham no sentido de ratificar um paradigma social que vincula negritude com criminalidade, associando a subjetividade do indivíduo negro à ideia de marginalização, e, portanto, destinando a esse indivíduo um espaço de sujeição criminal. A pesquisa apresenta esses elementos a partir de dados empíricos decorrentes de observação etnográfica de quinze audiências nas varas criminais na cidade do Recife, no segundo semestre de 2015, cujos dados foram interpretados à luz da teoria do labeling approach e da sujeição criminal, concluindo que há um caminho que vai do racismo no âmbito social para o racismo institucional que manifesta-se no sistema penal.

Abstract: The paper points racism as a structure in the punitive system practics. The authors show how black people are more vulnerable to the impact of criminal machine, in the way labelling mechanisms and stigmatization works to ratify a social paradigm that links blackness to criminality by associating the subjectivity of the black people to the idea of marginalization, and therefore, the destination of this individual is a criminal subjection place. The research presents those elements from a ethnografic work with observation of fifiteen criminal courts in Recife, Brazil, in the second semester of 2015, which variables were interpreted by labelling approach and criminal subjection, leading to the conclusion that exists racism from the social sphere up to the institucional, that is manifested in the criminal justice system.
