Diante de uma série de decisões do Supremo Tribunal Federal (STF), no que tange ao marco inicial da execução penal e a dispensabilidade do trânsito em julgado da condenação, levanta-se a seguinte problemática: o STF enfrentou adequadamente as questões jurídicas necessárias para fixar seu entendimento quanto à citada matéria, em respeito à coerência e integridade do direito? Acredita-se que a Corte agiu de modo pragmático, respondendo ao caso com fundamentos vulgarizantes da interpretação constitucional e dos aspectos princípiológicos, quando a questão seria resolvida de modo diverso, sem maiores esforços, pela aplicação quase “literal” da lei e da própria Constituição. Para tanto, a presente pesquisa objetiva propor análise crítica às decisões do Tribunal na citada matéria, amparada na teoria de Ronald Dworkin.

In light of a series of decisions from Brazilian Supreme Court concerning the initial boundary for executing penal sentences and the dispensability of res judicata for enforcing the criminal conviction, the following problem was raised: has Brazilian Supreme Court properly addressed the legal issues needed to establish its opinion, in respect for the coherence and integrity of law? It is believed that the Court acted pragmatically, answering to the case by vulgarizing constitutional interpretation and principiological aspects, when the matter would be resolved differently, without major efforts, by an almost “literal” application of the law and the Constitution. Therefore, the present research aims to propose a critical analysis to the decisions of the said Tribunal in the discussed issue, anchored by the theory of Ronald Dworkin.
