Com o presente artigo, questionam-se as relações intercorrentes entre as exigências de repressão dos ilícitos penais e os direitos dos cidadãos ao sigilo das comunicações e à inviolabilidade do domicílio no ordenamento italiano. Trata-se, portanto, de verificar se atualmente a atenção do legislador e seu relativo baricentro são demasiadamente desequilibrados em favor da repressão nos procedimentos contra crimes organizados, ou, ao contrário, são excessivamente pendentes à proteção de direitos fundamentais nos procedimentos contra crimes comuns.
With this contribution the author examines the intercurrent relations between the demands of repression of the criminal offenses and the rights of the citizens to the secrecy of the communications and the inviolability of the domicile in the Italian legal system. It is therefore a matter of verifying whether the attention of the legislator and his relative barycenter are overly unbalanced in favor of the first one in proceedings against organized crime, or rather are excessively pendent in favor of the others in proceedings against ordinary crimes.
