Na história do estudo do crime organizado, diversas teorias foram desenvolvidas para explicar as suas causas, o seu conceito e a sua origem, até se chegar no entendimento do crime organizado como empresa ilícita. O presente trabalho parte desse conceito para tecer algumas notas críticas, especialmente quanto à postura acrítica ao capitalismo, à forma como se naturaliza o caráter proibitivo, e à operatividade social da repressão às atividades econômicas ilícitas.
In the studies of organized crime throughout history, several theories were developed to explain its causes, concept and origin, until the understanding of the organized crime as an illegal enterprise was reached. The present article approaches this concept to draw some critical notes, especially about the lack of criticism toward capitalism, the way prohibition is seen as natural and the way the repression of the illegal economic activities socially occurs.
