A Lei de Segurança Nacional de 1983 constitui uma legislação própria doregime de transição ao Estado de Direito. Se, por um lado, alguns artigos confrontam aordem constitucional ora vigente, por outro, alguns dispositivos devem ser interpretadosem conformidade à Constituição Federal, visando a tutela de atos atentatórios aofuncionamento das instituições democráticas. Em busca de aperfeiçoamento, háprojetos de lei prevendo dispositivos em Defesa do Estado Democrático de Direito.Contudo, precisam ser aprimorados, seja com novas redações, seja com inclusão denormas que protejam novos ataques à democracia. Papel importante cabe ao SupremoTribunal Federal no exame de arguições de inconstitucionalidade.
he 1983 National Security Law constitutes legislationspecific to the regime of prior transition to the rule of law. If, on the onehand, some articles confront the current constitutional order, on the otherhand, some provisions must be interpreted in accordance with the FederalConstitution, aiming at protecting acts that undermine the functioning ofdemocratic institutions. In search of improvement, there are bills foreseenprovisions in Defense of the Democratic Rule of Law. However, they needto be improved, either with new wording or with the inclusion of rules thatprotect new attacks on democracy.
