O artigo discute a relativização do princípio da indeclinabilidade ou da vedação ao non liquet no contexto da ordem jurídica brasileira. Fundamenta a base da discussão na teoria das capacidades institucionais, preconizada nos estudos de Cass Sustein e Adrian Vermeule e teorizada na obra intitulada Interpretation and institutions. Abordar a possibilidade de aplicação prática do princípio de modo adequado ao sistema processual do Brasil contemporâneo. Demonstra a existência de vários casos em que a aplicação da teoria das capacidades institucionais poderá fundamentar o declínio de competência do Poder Judiciário. Considerando a hipótese a justiça afastasse do caso eximindo-se da responsabilidade de decidir naquelas questões que evidentemente demanda um alto grau de expertise técnica-científica. Assim sendo considera a necessidade de preenchimento dos pressupostos, e declara com fundamento na teoria das capacidades institucionais que somente ao Poder Judiciário é cabível declarar o non liquet. Assim será possível perceber aptidão para que outra instituição possa apresentar uma melhor solução ao caso.

The article discusses the relativization of the principle of indeclinability or the prohibition against the non liquetin the context of the Brazilian legal order. It bases the basis of the discussion on the theory of institutional capacities, advocated in the studies of Cass Sustein and Adrian Vermeule and theorized in the work entitled Interpretation and institutions. Approach the possibilityof applying the principle in a way that is appropriate to the procedural system of contemporary Brazil. It demonstrates the existence of several cases in which the application of the theory of institutional capacities may justify the decline in the competence of the Judiciary. Considering the hypothesis, justice would depart from the case, relieving itself of the responsibility of deciding on those issues that evidently demand a high degree of technical-scientific expertise. Therefore, it considers the need to fill in the assumptions, and declares based on the theory of institutional capacities that only the Judiciary is entitled to declare the non liquet. Thus, it will be possible to perceive the aptitude for another institution to present a better solution to the case.
