O presente artigo versa sobre os limites e a legitimidade do controle judicial em face da Administração Pública, em especial no que tange ao processamento e julgamento de Prefeitos pela prática de infrações político-administrativas perante a Câmara Municipal, sob o crivo do Dec.-lei 201/1967. Serve o estudo como alerta para o mau uso do diploma legislativo em questão, de modo a se evitar que titulares de mandato eletivo, legitimamente eleitos pela população, sejam indiscriminadamente cassados com base em interesses estritamente individuais e partidários.
Resumo Inglês:
This article studies the limits and legitimacy of the judicial control related to the Public Administration, particularly with regard to the processing and judgment of Mayors in relation to political-administrative violations before the Municipal Council, under the scrutiny of the Decree-Law 201/67. The purpose of the present study is to warns the misuse of the relevant statute in order to prevent the indiscriminately revocation of the electoral mandate holders, who are elected by the population, strictly based on individual and partisan interests.
