Considerando o espaço que a justiça consensual vem ganhando, nos últimos anos, perante o processo penal brasileiro, o objetivo deste estudo é analisar os limites da jus-tiça penal negociada no ordenamento jurídico pátrio. Propõe-se, por meio do método dedutivo e da pesquisa bibliográfica, abordar a delimitação imposta pelos direitos e garantais fundamentais, e pelo princípio da oportunidade regrada sob os acordos penais. Conclui-se que a justiça penal consensual deve ser aplicada de forma a resguardar as garantias fundamentais do réu, e a negociação entre as partes deve respeitar os parâmetros legais, para que possa ser considerada legítima e efetiva.
Considering the space that consensual justice has been gaining, in recent years, in the Brazilian criminal process, the objective of this study is to analyze the limits of criminal justice negotiated in the national legal system. It is proposed, through the deductive method and through bibliographic research, to approach the delimitation imposed by the fundamental rights and guarantees and by the principle of opportunity ruled under the penal agreements. It is concluded that consensual criminal justice must be applied in order to protect the fundamental guarantees of the defendant and the negotiation between the parties must respect the legal parameters, so that it can be considered legitimate and effective.
