O sucesso e a diversidade de possíveis aplicações da Inteligência Artificial fizeram com que sua aplicação fosse expandida largamente. Ocorre que a ampla utilização de ferramentas de IA não é isenta de riscos e desafios. Além da preocupante questão dos vieses algorítmicos, observam-se situações em que há evidente violação de direitos fundamentais dos cidadãos. Em decorrência dessa problemática, a Comissão Europeia apresentou uma proposta regulatória abrangente para a Inteligência Artificial. Essa análise partiu do conceito de IA, dos algoritmos e do risco de contaminação dos dados, de modo a explicitar o enviesamento algorítmico. Em um segundo momento, passou-se a analisar criticamente a proposta de regulação apresentada pelo Conselho Europeu, tomando-se por base os direitos e as garantias fundamentais. Para tanto, utilizou-se o método hipotético dedutivo, com lastro em pesquisa bibliográfica sobre Inteligência Artificial. Por fim, concluiu-se que, embora a proposta não seja isenta de críticas, se aprovado, o marco regulatório europeu deve funcionar como paradigma ao mundo, uma vez que conseguiu uma rara precisão ao regular a matéria com a abrangência e a profundidade necessárias, respeitando os direitos fundamentais e fomentando o desenvolvimento de cada vez mais inevitáveis inovações tecnológicas.

The success and diversity of possible applications of Artificial Intelligence made its application to be expanded widely. It so happens that the widespread use of AI tools is not without its risks and challenges. In addition to the worrying issue of algorithmic biases, there are situations in which there is an evident violation of citizens’ fundamental rights. As a result of this issue, the European Commission presented a comprehensive regulatory proposal for Artificial Intelligence. This analysis started from the AI concept, algorithms and the risk of data contamination, in order to explain the algorithmic bias. In a second moment, the proposal for regulation presented by the European Council began to be critically analyzed, based on fundamental rights and guarantees. Therefore, the deductive hypothetical method was used, based on bibliographic research on Artificial Intelligence. Finally, it was concluded that, although the proposal is not exempt from criticism, if approved, the European regulatory framework should function as a paradigm for the world, since it achieved a rare precision in regulating the matter with the necessary scope and depth, respecting fundamental rights and fostering the development of more and more inevitable technological innovations.
