O artigo destinou-se a investigar as contribuições do direito internacional dos direitos humanos, mormente de órgãos do sistema interamericano de direitos humanos – Comissão Interamericana e Corte Interamericana de Direitos Humanos –, para a efetiva proteção dos direitos humanos durante momentos de emergências sanitárias, como ocorreu com a pandemia do COVID-19. Por meio da análise dos acontecimentos marcantes da pandemia do novo coronavírus, constatou-se que as repercussões da crise sanitária afetaram não somente a saúde da população mundial, mas também inúmeros outros direitos e aspectos essenciais da vida social, que por vezes gerou comportamentos estatais e privados violadores de direitos humanos. Nessa toada, buscou-se analisar e sistematizar pronunciamentos da Comissão Interamericana e da Corte Interamericana de Direitos Humanos no contexto da pandemia, os quais se traduzem em verdadeiros parâmetros de atuação para que países possam enfrentar crises e emergências sanitárias, mas também atuar na promoção e proteção dos mais diversos direitos humanos afetados nesse contexto.
The article aimed to investigate the contributions of international human rights law, especially that of organs of the inter-American human rights system – the Inter-American Commission and the Inter-American Court of Human Rights – to the effective protection of human rights during times of health emergencies, such as the COVID-19 pandemic. Through the analysis of the remarkable events of the new coronavirus pandemic, it was found that the repercussions of the health crisis affected not only the health of the world's population, but also countless other rights and essential aspects of social life, which sometimes generated state and private behaviors that violate human rights. In this way, we sought to analyze and systematize the pronouncements of the Inter-American Commission and the Inter-American Court of Human Rights in the context of the pandemic, which translate into true parameters of action so that countries can face crises and health emergencies, but also act in the promotion and protection of the most diverse human rights affected in this context.
